Many tour operators publish the following requirements for the crossing of children by Russia-Abkhazia borders: if a child under 18 crosses the border with only one parent, a second notarized power of attorney for his departure from the country is required from the second parent. It is mandatory to have a birth certificate with you (even if you have a passport) to establish the relationship of the child with the parent accompanying him.

At the same time, if one of the parents (adoptive parents, guardians or trustees) has declared disagreement on the departure of a minor Russian citizen from Russia, the issue of the possibility of his leaving the country can be resolved only through the courts.

On the other hand, according to σ .20 of the Federal Law from 15 .08 .1996 № 114-ФЗ (ред .from 21 .04 .2011 г .) "On the procedure for leaving the Russian Federation and entry into the Russian Federation", if the child travels with one of the parents, the consent of the second is not required..We quote st .20 FZ-114: "A minor citizen of the Russian Federation, as a rule, leaves the Russian Federation jointly with at least one parent, adoptive parents, guardians or trustees..In the event that an underage citizen of the Russian Federation leaves the Russian Federation unaccompanied, he must carry along with him / her a notarially registered consent of the named persons for the departure of a minor citizen of the Russian Federation, specifying the time of departure and the state (states) that he intends to visit ».

According to the legal practice, letters of the FSB of June 27, 2007 N 21/1/7/3 and comments of existing lawyers to the Law 114-FZ, this conclusion is confirmed: for the crossing of the Russia-Abkhazia border, it is sufficient to accompany the native of the parents (adoptive parents, guardians or trustees), or permission to cross the border from one of the parents and other named persons.
